Question and a bit of advice needed..

Was stopped last year on the Kilcullen Road coming out of of Naas. I was filtering traffic as it was bumper to bumper, and as that road is a continuous white line I was on it and just over it on occasions.. An unmarked car pulled me in while they were sitting in traffic ahead of me and issued me a ticket.
Didn't receive the FPN and now have me a day in court..

Question or advise needed, as I'm not sure is it worth going and talking to the judge, I think it's harsh and not really keen on the points and 160€ / 5 points now that I've to go to court..

Is it worth going or just paying it and taking the 3 points?

Around about a year ago i had the same kind of thing happen , i was told by a lawyer to just take the hit odds are i wasn't going to win their words .

Given you broke the line you are in the wrong i would say play the game take the fine as it can be an increased fine if it doesn't go your way in court .

Is it 5 points for one offense or is there more that one? If it’s the latter you will only receive the points for whichever one carry’s more points....either way you definitely need to mention that you never received notice

Ah I'll defo be going, just I have the option on the summons to pay it but I'm the fine is double that of the FPN.
Will go have a word with the judge and see what happens 😒

Judges are a strange breed and not to be treated as if they are logical human beings.

An idiot I used to work with got done for speeding in his cage, twice in the same day, by the same very well known fixed camera. First on his way to an appointment and then again on his way home later that same day. Idiot. He paid one of the fines and ignored the other because he thought that the second one was a duplicate ticket sent in error (he never noticed that the times on the two tickets were different).

He got the letter to appear in court. He already had 6 points on his licence, all for speeding. Anyway, at the insistence of a relative of his, a solicitor was hired to accompany him to court and speak on his behalf, because he's a fucking idiot with a loud mouth and absolutely no filter between the thoughts that enter his head and the words that come out of his mouth.

Every single other case that was heard got fines and driving bans, he was the only person that had a solicitor and the judge thanked him for showing the court and the entire justice system due respect. Paid the fine and no extra points.

About three weeks after his day in court, I was heading home from work and he overtook me in an 80kph zone, I'd say he was comfortably doing 140kph. Donkey.

Judges vary, some will let you off with just the fine and points you should have got had the FPN got to you, if you say you didn't get the FPN. So may come to court with this story though, they take a dim view of it.

To be fair, I have found most gardas will ignore you filtering if you keep the speed well down and you dont zig zag in and out of traffic.

Seen lads being stopped ahead of me for filtering at near speed limit, and then filtered through myself with no bother. When filtering I keep the speed right down (less than 40 kph, quite often a lot slower than that if the traffic is heavy).

I was doing 10mph tops, I'd probably pay the 80 quid and move on but double the fine now for not receiving the fine in the first place...

And yeah, driving off would of worked a few years back but needing the license for work and didn't really fancy been a 5 second hero for the boys to show up later in the day... Top tips tho 🤔

I just dont understand that, dont get me wrong not saying your lying, but what was the guard thinking? What harm could you have possibly done at that speed?

I truly wish there was a proper and active bikers organisation here in Ireland that could hammer out these issues with the guards and the Judiciary. It should be clear and simple as to what is acceptable ad what is not, instead of leaving it ti a guard who might have been having a bad day, or indeed a guard who is working to his own agenda.

Racing away from an incident is NEVER a good option so dont consider it even if its posted in BIKER.IE

Also state; ya did not get the letter in post, ya need the licence for work and have done so all along. Emphasise that ya would not have wilfully caused further damage to yer licence by ignoring the fixed fine...when any reasonable person already knows the outcome of doing zthat.

I've personally seen people get away with the claim they never got the letter, and in same court on a different date have seen the exact opposite. Hopefully ya will get the judge and the cops on a good day, they seem to confer in the decision to accept the defence claim.


If all else fails ya can always threaten them with our interwebs resident hard man. Apparently part of his repertoire of mma skills is the ability to bore his victims to death.

Judge Zaidan is in Naas and takes a fairly heavy hand with bikers.

They have introduced this 3rd option to pay as a way to stop people claiming they didn't get the notice, irrespective of whether they did or not if you get me.

Ur taking ur chances with that judge and while the 3rd option to pay is higher then the original it is still potentially less then u'll walk away with from Naas plus less points

..any witness to say that you weren't "flying" it? Also I understood per rules of the road that you can overtake on a continuous white line if traffic is going slow provided safe to do so i.e. tractor in front of you however never cross a double white. You state traffic was bumper to bumper ... was traffic moving slowly or stopped?

Got notice of an increased unpaid parking fine for the cage. Never got the ticket or a reminder but did get the increased ticket for non-payment. Decided it was unfair and challenged it all the way! Letters to the private parking company etc. Judge took one look at a photo of the offence and said it was obvious I was parked badly and offered me a fine or a payment to a charity? I argued how was I expected to pay a fine I knew nothing about but he was having none of it. €100 to the hospice and case struck out!!!

Everybody else got double the fine and €75 Court costs.

I "think" he had a family tradgedy many moons ago involving a traffic accident and ever since has been on a mission when it comes to road traffic offences of any kind.

But this could just be an urban myth round these parts.
