Default Stopped on N11 this Morning for filtering. Warning!!

Hi All,

So I was stopped this morning on the N11 traveling to work by a Guard (on a bike himself) this morning. He was hidden on the hard shoulder. He pulled me over for filtering to which he said because the traffic wasn't stationary I had no need to filter. Traffic was moving slightly around 20kph or so, I was doing just over 50kph in a 100kph zone.

He proceeded to tell me that fitering isn't illegal yet still issued me a ticket for 3 points and €80 under the traffic act 50a or something along the lines.

He also stated that he had pulled in 3 other motorcyclists for the same thing that morning.

I'd accept it if I was speeding or dangerous driving but surely filtering isn't an offence especially during rush hour traffic.

Warning: He said they will be out to catch people on bikes doing the same and clamping down hard on it.

Any thoughts on this?

.dangerous driving is a pretty serious offence to charge anyone with, perhaps careless driving or driving without due care/consideration....I dunno.

He didn't even hand me a ticket. Wrote it in his book and said to expect it in the post in a while as he is on holidays for the next 2 weeks.

His words exactly. "You were by no means speeding or dangerous driving but I will have to give you a ticket under the traffic act". Think he quoted 50a or something along those lines

..possibly 51A:

"A less serious charge is driving without reasonable consideration as set out in section 51A(1) of the Road Traffic Act 1961.

There is no definition in law of “driving without reasonable consideration” but it is generally considered to be acting like a nuisance on the roads"

.... does that fit the bill ....

I'd say that was close to what he was trying to explain. I know a few people have had dealings with this guy in particular. So I just nodded and went on my merry way.

What were you actually doing - going between two lines of traffic, or up the outside crossing solid lines or anything ?

I was in the dead center of the road going between two solid lines of traffic, Wheels just in the right lane. Use this road everyday doing the same thing for last 4/5 years not an issue until today.

that's what I got a few months ago , was going to go all the way to court but it's the guards word against yours , so I just took the fine and points , I was pulled for reg size and driving to close to the vehicle in front of me , which I didn't think I was

Not that it makes a huge difference, but - technically - with the traffic on the move you were overtaking, not filtering. If you cross a solid line they can take a dim view - it sounds a bit harsh, They could probably book most of us for that if they took a mind to.

Wonder what's driving yer man just now - new to the job, change of policy, or just got out of the wrong side of the bed perhaps.

I got done for this too .... similar location, I was told by the gaurd "theres no law that allows you to filter" I told him there is no law that says I cant and in fact the RSA has guidelines on it...Cunt still done me for undue care and attention I think it was.... I was doing around 50 in a 100 while the traffic was crawling along.
And don't bother fighting it in court, the judge in bray has a thing for motorcyclists.
Buddy of mine also got done recently for the same thing.....Only this time he was filtering up to a red light in between the two lanes of stationary traffic. Same shit..... undue care and attention.
